IMPORTANT NOTE: By using the Site, viewing Content, submitting information through Acuity Scheduling, contacting Mindful Flow Counseling and Yoga, LLC, or otherwise interacting with the Site, you voluntarily agree to be bound by this Privacy Policy.
This Privacy Policy applies to general use of the Site. It does not replace any clinical privacy documents, psychotherapy informed consent documents, HIPAA-related documents, or Notice of Privacy Practices that may apply if you become a psychotherapy client of Mindful Flow Counseling and Yoga, LLC.

1. Definitions
For purposes of this Privacy Policy:
“Company,” “we,” “I,” “our,” or “us” means Mindful Flow Counseling and Yoga, LLC and www.mfcounselingandyoga.com. For public-facing purposes, the Company may also refer to itself as Mindful Flow Counseling & Yoga.
“Content” means any and all written, visual, video, audio, downloadable, digital, or educational information contained on or connected to the Site. This includes, but is not limited to, website copy, blog posts, articles, emails, newsletters, graphics, videos, forms, scheduling pages, resources, social media content, and any other material made available through or connected to the Site.
“Personal Information” means information that can be used on its own or in conjunction with other information to identify, contact, or locate a person, or to identify an individual in context. For example, Personal Information may include your name, email address, phone number, mailing address, date of birth, insurance or payment-related information, website behavior, IP address, device information, and other information you choose to submit through the Site or scheduling tools.
“Protected Health Information” or “PHI” means individually identifiable health information that may be protected under applicable health privacy laws when collected, used, maintained, or transmitted in connection with psychotherapy services.
“Site” means www.mfcounselingandyoga.com and any and all of the Company’s associated pages, tabs, landing pages, forms, scheduling links, resources, or subpages.
“Services” means psychotherapy services offered by Mindful Flow Counseling and Yoga, LLC to eligible clients located in Pennsylvania, as well as any future services, offerings, workshops, courses, yoga videos, yoga-related services, coaching, digital products, retreats, or educational resources that may be offered by the Company. Not all listed Services are currently available.
“You” or “your” means the user, customer, viewer, visitor, potential client, client, or other person accessing or using the Site, Content, scheduling tools, or Services.
2. Company Statement
The Site and its Content are owned by Mindful Flow Counseling and Yoga, LLC.
Mindful Flow Counseling and Yoga, LLC is committed to protecting your Personal Information. We will only collect, use, or disclose your Personal Information in accordance with this Privacy Policy and applicable law.
Mindful Flow Counseling and Yoga, LLC is a mental health/private practice business. Because the Company may receive sensitive information from prospective or current therapy clients, users should be careful not to submit unnecessary sensitive information, clinical details, emergency information, or protected health information through general website features or unsecured communication channels.
3. Website Privacy Policy and Clinical Privacy Practices Are Separate
This Privacy Policy applies to general website use, including information collected through the Site, Acuity Scheduling, website analytics tools, cookies, and similar website features.
If you become a psychotherapy client of Mindful Flow Counseling and Yoga, LLC, your clinical information may be subject to separate privacy practices, including the Company’s Notice of Privacy Practices, HIPAA-related documentation, informed consent documentation, client portal policies, and other clinical privacy documents.
The website Privacy Policy does not replace the Notice of Privacy Practices or psychotherapy informed consent documents.

4. What Kind of Personal Information Do We Collect?
Personal Information You Provide
When using the Site, submitting information through Acuity Scheduling, requesting information about psychotherapy services, contacting us, or otherwise submitting information through or connected to the Site, you may be asked to enter certain Personal Information.
At this time, information collected through the Site or Acuity Scheduling may include:
name;
phone number;
email address;
reason for seeking treatment;
insurance provider or whether you are self-pay; and/or
date of birth or birthday information.
Because this Site relates to mental health services, some information you submit may be sensitive. Please do not submit unnecessary clinical details, protected health information, emergency information, diagnosis details, detailed trauma history, insurance identification numbers, Social Security numbers, payment card information, or other highly sensitive information through general email, general website features, or unsecured communication channels.
Sensitive intake, scheduling, and treatment-related information should be submitted only through the scheduling, portal, or intake method specifically provided by Mindful Flow Counseling and Yoga, LLC for that purpose.
If we determine that your inquiry may be an appropriate fit, we may send you a scheduling link or other next-step information. Submitting information, receiving a response, or receiving a scheduling link does not create a therapist-client relationship.
Personal Information Automatically Collected
Through use of the Site, the Company may use data collection technologies and third-party tools, including Squarespace analytics tools, Google Analytics, cookies, and similar technologies, to collect information related to your use of the Site.
Generally speaking, this may include information about your Site behavior, pages viewed, links clicked, approximate geographic location, browser type, device type, operating system, referring website, IP address, and whether you view the Site on mobile, tablet, or desktop.
We collect this information for statistical, website performance, security, and user-experience purposes, and to improve the Site and Content.
We do not currently use Google Ads. We do not currently use social media advertising pixels to target advertisements to Site visitors.
5. Acuity Scheduling and Intake Information
The Site may use Acuity Scheduling to collect scheduling and intake-related information from prospective clients.
Information submitted through Acuity Scheduling may include name, email address, phone number, reason for seeking treatment, insurance or self-pay status, date of birth or birthday information, appointment preferences, and other information requested as part of the scheduling or intake process.
Mindful Flow Counseling and Yoga, LLC intends to use Acuity Scheduling in a manner appropriate for a mental health practice and sensitive intake information. However, no online system is guaranteed to be completely secure.
If you are asked to submit sensitive information, you should submit only the information requested and should not include unnecessary details. Do not use Acuity Scheduling, email, or website tools for emergencies or urgent clinical needs.
6. When Do We Collect Personal Information?
We collect Personal Information from you when you:
browse or use the Site;
view Content;
submit information through Acuity Scheduling;
email us or otherwise contact us;
request information about psychotherapy services;
receive or use a scheduling link;
interact with Site features;
participate in any future newsletter, updates, or email list, if added;
participate in any future offering, workshop, course, yoga-related service, digital product, or other service; or
enter any of your Personal Information on or through the Site or related scheduling tools.
If you are simply viewing the Site, you generally will not be required to provide your name, email address, phone number, or other contact information to browse. However, certain technical information may be automatically collected through cookies, analytics tools, server logs, or similar technologies.
7. How Do We Use Your Personal Information?
When using the Site, Acuity Scheduling, or related tools, we may use the Personal Information we collect from you in the following ways:
To respond to inquiries, requests, or questions.
To determine whether Mindful Flow Counseling and Yoga, LLC may be an appropriate fit for your requested services.
To send scheduling information or next-step information when appropriate.
To communicate with you about potential or current services.
To provide administrative support related to inquiries, scheduling, intake, or services.
To confirm adult status because the Company does not currently serve minors through the Site.
To understand insurance or self-pay considerations.
To improve the Site and user experience.
To better understand how visitors use the Site.
To monitor and improve website performance, functionality, and security.
To comply with applicable legal, regulatory, ethical, professional, or safety obligations.
To protect the rights, safety, property, or operations of the Company, users, clients, or others.
To send future newsletters, educational updates, or marketing communications only if such features are added and where permitted by law.
We do not use information submitted through Acuity Scheduling or clinical inquiry processes for Google Ads. We do not currently use social media advertising pixels to target advertisements to Site visitors.
8. Reason for Seeking Treatment, Insurance Information, and Birthday Information
Because the Site relates to psychotherapy services, the Company may collect limited information to understand your inquiry and determine next steps. This may include your reason for seeking treatment, insurance provider or self-pay status, and date of birth or birthday information.
This information may be sensitive. The Company uses this information only for legitimate practice-related purposes, such as responding to your inquiry, determining whether the practice may be an appropriate fit, confirming adult status, identifying insurance or payment considerations, and sending appropriate next-step information.
Submitting this information through the Site or Acuity Scheduling does not create a therapist-client relationship. A therapist-client relationship is formed only when you have completed the intake process, Mindful Flow Counseling and Yoga, LLC has agreed to provide psychotherapy services to you, and all required consent, privacy, practice, and payment documents have been completed.
9. Do We Share Your Personal Information With Anyone?
In general, we do not sell, trade, or otherwise transfer your Personal Information to outside third parties for marketing or advertising purposes.
We may share or disclose Personal Information in the following circumstances:
with service providers, platforms, contractors, or vendors who help us operate the Site, manage communications, provide analytics, maintain technology systems, provide scheduling tools, support the client portal, or conduct business operations;
with Squarespace, Acuity Scheduling, Google Analytics, Google Workspace, SimplePractice, email providers, scheduling tools, and other technology providers as needed to operate the Site or business;
when required or permitted by law, regulation, legal process, court order, subpoena, law enforcement inquiry, licensing board inquiry, government request, or other legal obligation;
when necessary to protect the rights, safety, property, or operations of the Company, users, clients, or others;
in connection with a business transition, such as a merger, restructuring, sale, transfer, or assignment of all or part of the business, subject to applicable law;
with your consent; or
as otherwise described in this Privacy Policy.
We may disclose Personal Information to contractors, subcontractors, assigns, affiliates, vendors, or successors in interest when necessary to carry out our business functions, so long as appropriate confidentiality or privacy obligations are in place where required.
Non-personally identifiable visitor information, aggregated information, or de-identified analytics information may be used to understand Site traffic, Site interaction, and general user behavior.
If you make your Personal Information available to third parties through links, third-party platforms, external websites, or services outside of our control, Mindful Flow Counseling and Yoga, LLC is not responsible for any unauthorized use by that third party.
It is also important to note that we allow certain third-party analytics and website functionality tools, including Google Analytics and Squarespace-related cookies or analytics, which may track visitor behavior on the Site. We do not currently use Google Ads or social media advertising pixels.
10. Payment Information and SimplePractice
Payment for psychotherapy services is not processed directly through this Site. Payments for psychotherapy services are processed through the SimplePractice patient portal or another approved payment method provided in connection with clinical services.
Please do not submit credit card information, bank account information, insurance identification numbers, Social Security numbers, or other payment-related sensitive information through general email or general website features.
SimplePractice and any other third-party payment or client portal provider may have their own privacy, security, and terms documents. You should review those documents when using their services.
11. Email and Google Workspace
The Company uses Google Workspace for email and business communications.
Email may not be a fully secure method of communication. Please do not send emergency information, urgent clinical concerns, detailed clinical information, diagnosis details, insurance identification numbers, Social Security numbers, payment card information, or other highly sensitive information by email unless specifically instructed to do so through an appropriate secure method.
If you become a psychotherapy client, clinical communication expectations may be governed by the Company’s informed consent, Notice of Privacy Practices, client portal policies, and other clinical documents.
12. How Do We Protect Your Personal Information?
We aim to make your visit to the Site as safe as possible. The Site uses commercially reasonable methods of security protection to protect your information.
The Site uses HTTPS/SSL technology where available to help protect information transmitted through the Site. However, no website, email, scheduling tool, electronic communication, or internet transmission is guaranteed to be completely secure.
Your Personal Information is accessible only to those who have a legitimate need to access it for business, administrative, website, scheduling, clinical intake, legal, or operational purposes.
By viewing, using, or submitting information through the Site, Acuity Scheduling, email, or related tools, you acknowledge that Mindful Flow Counseling and Yoga, LLC and its authorized service providers, vendors, contractors, or technology platforms may access Personal Information as necessary to operate the Site and business.
Because general website features and email communications may not be fully secure or appropriate for sensitive clinical information, you should avoid submitting unnecessary sensitive information through the Site or email.
13. Do We Use Cookies, Analytics, or Social Media Pixels?
Cookies
The Site is hosted on Squarespace and may use cookies and similar technologies. Cookies are small data files that a site or its service provider transfers to your computer, mobile phone, or other device through your web browser, if your browser allows, that enables the site or service provider’s systems to recognize your browser and capture and remember certain information.
We and third-party providers may use cookies and similar technologies to:
help the Site function properly;
improve Site performance;
remember certain visitor preferences;
compile aggregate data about Site traffic and Site interactions;
understand how visitors use the Site;
improve Site experiences and tools in the future; and
support website security, performance, analytics, and functionality.
You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off certain cookies through your browser settings. Since each browser is different, consult your browser’s Help Menu to learn the correct way to modify your cookies.
If you disable cookies, some Site features may not function properly.
Google Analytics
The Company uses Google Analytics, which has been added to the Site by code, to better understand how visitors use the Site. Google Analytics may collect information such as pages visited, time spent on pages, device type, browser type, approximate location, referring website, IP address, and other usage information.
Google Analytics uses cookies and similar technologies to provide reports about Site usage. We use this information to understand Site traffic and improve the Site. We do not intentionally use Google Analytics to identify individual visitors personally.
We do not intentionally send names, email addresses, phone numbers, date of birth, insurance information, treatment inquiry information, or other personally identifying information to Google Analytics. Website pages, forms, URLs, page titles, and tracking code should not be configured in a way that sends personally identifying information or protected health information to Google Analytics.
You may be able to opt out of certain Google Analytics tracking by using tools provided by Google or by adjusting your browser or cookie settings.
Social Media Pixels
The Company does not currently use social media pixels, such as Meta/Facebook pixels, to track visitors to the Site or tailor advertisements on social media platforms.
If the Company uses social media pixels or similar advertising tracking technologies in the future, this Privacy Policy should be reviewed and updated.
14. Third-Party Links
Occasionally, at our discretion, we may include or offer third-party links, resources, articles, blogs, websites, platforms, products, services, or tools on the Site.
These third-party sites may have separate and independent privacy policies. We have no responsibility or liability for the content, privacy practices, security, policies, availability, or activities of linked third-party sites or services.
Nonetheless, we seek to protect the integrity of the Site and welcome any feedback about issues you experience with linked-to sites by emailing us at info@mfcounselingandyoga.com.
15. No Membership or Password-Protected Website Pages
The Site does not currently include membership pages, user accounts, or password-protected pages for general website visitors.
If membership pages, password-protected pages, courses, client dashboards, or user accounts are added in the future, this Privacy Policy should be reviewed and updated before those features are enabled.
Psychotherapy clients may receive access to a separate client portal, such as SimplePractice. Client portal access is governed by separate platform terms, privacy practices, and applicable clinical documents.
16. California Online Privacy Protection Act (“CalOPPA”)
CalOPPA requires certain websites that collect Personal Information from California consumers to post a conspicuous privacy policy stating the information being collected and those individuals or companies with whom it is shared.
Pursuant to CalOPPA, we agree to the following:
Users can visit the Site without submitting their name, email address, phone number, or scheduling information.
A link to this Privacy Policy is available on the Site, including in the website footer or another conspicuous location.
The Privacy Policy link includes the word “Privacy” and is clearly titled “Privacy Policy.”
Users will be notified of Privacy Policy changes on this Privacy Policy page by reference to the “Updated On” date.
Because analytics tools and cookies may automatically collect technical or usage information, visiting the Site may not be completely anonymous from a technical standpoint.
17. Children’s Online Privacy Protection Act (“COPPA”) and Minors
We do not specifically market to children under the age of 13.
This Site is intended for adults age 18 and older. Mindful Flow Counseling and Yoga, LLC does not currently provide psychotherapy services to minors through this Site.
Please stop and do not use, view, submit information through, or otherwise browse the Site if you are under 18 years old. If you are under 18, you are not permitted to enter any Personal Information on this Site or through Acuity Scheduling.
If you are a parent or legal guardian and you believe your child has provided us with Personal Information, please contact us immediately to request removal by emailing info@mfcounselingandyoga.com.
18. Fair Information Practices and Data Breach Response
In order to comply with Fair Information Practices and applicable data security obligations, we will take reasonable responsive action should a data breach occur.
If we become aware of a data breach affecting Personal Information or Protected Health Information, we will take reasonable steps to investigate, respond, mitigate harm where appropriate, and provide notices as required by applicable law.
The timing, method, and content of any notice will depend on the type of information involved, the nature of the incident, and applicable federal or state law.
19. CAN-SPAM Act of 2003
The CAN-SPAM Act is a U.S. law that establishes rules for certain commercial email messages, gives recipients the right to stop certain commercial emails from being sent, and outlines penalties for violations.
The Company does not currently operate a newsletter or email list. The Company may collect your name and email address so we can:
send information;
respond to inquiries, requests, or questions;
provide next-step information when appropriate;
communicate about potential or current services;
send administrative or service-related emails; and/or
send future newsletters, educational emails, or marketing communications if such features are added and you are subscribed or otherwise permitted to receive them.
In accordance with the CAN-SPAM Act, we agree to the following:
We will not use false or misleading subjects or email addresses.
We will identify commercial email messages as advertisements when required by law.
We will include our business mailing address and/or physical address in commercial emails when required by law.
We will honor opt-out/unsubscribe requests as required by law.
We will allow users to unsubscribe from marketing emails by using the appropriate link at the bottom of marketing emails when such emails are used.

Please note that unsubscribing from marketing emails may not prevent you from receiving administrative, scheduling, legal, safety, or service-related communications.
20. General Privacy Rights and Requests
Depending on where you live, you may have certain privacy rights under applicable law. These may include the right to request access to certain Personal Information, request correction of inaccurate information, request deletion of certain information, or request information about how your Personal Information is used or shared.

If you are a current or former psychotherapy client, requests related to clinical records, protected health information, or psychotherapy records may be governed by separate clinical privacy practices, HIPAA-related documents, the Notice of Privacy Practices, professional obligations, and applicable law.
21. Your General Data Protection Regulation (“GDPR”) Rights
If you are located within the European Union or another jurisdiction with similar privacy rights, you may be entitled to certain rights under applicable privacy law.
These rights may include the right to:
know how long we keep certain Personal Information;
access, rectify, or erase certain Personal Information;
restrict or object to certain processing of your Personal Information;
withdraw consent to certain processing where consent is the legal basis for processing;
receive a copy of certain Personal Information in a portable format;
lodge a complaint with a supervisory authority that has jurisdiction over privacy matters; and
provide only Personal Information that is reasonably required to enter into a contract or relationship with us.
We are located in the United States and currently provide psychotherapy services only to clients located in Pennsylvania. If you are located outside the United States and access the Site, you understand that your information may be transferred to, processed in, or stored in the United States.

22. Data Retention
We retain Personal Information only for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.
Retention periods may vary depending on the type of information, whether you become a psychotherapy client, whether the information is part of a clinical or business record, whether legal or insurance obligations apply, and whether retention is necessary for security, dispute resolution, or business purposes.
Clinical records, billing records, and protected health information may be subject to separate retention requirements and clinical privacy practices.

We may update this Privacy Policy from time to time. The updated version will be posted on this page with a new “Updated On” date.
Your continued use of the Site after updates are posted means you accept the updated Privacy Policy.
